EXEMPT SERVICE POSITION The Agency for Persons with Disabilities
works in partnership with local communities to support people with
developmental disabilities in living, learning, and working in
their communities. APD provides critical services and supports for
customers with developmental disabilities to reach their full
potential. The Agency serves people with spina bifida, autism, Down
syndrome, children age 3-5 at high risk of developmental
disabilities, cerebral palsy, Prader-Willi syndrome,
Phelan-McDermid syndrome, and intellectual disabilities. There is
no charge or co-payment for services provided through the Agency.
DIRECT DEPOSIT PROGRAM - As a condition of employment, a person
appointed to a position in State government is required to
participate in the Direct Deposit Program. Rather than receiving a
paper paycheck, your funds will be deposited directly into your
account at your financial institution. This will be accomplished by
Electronic Funds Transfer. Banks, savings and loan associations,
and credit unions are eligible to accept such deposits. Retirement
funds are also required to be in the Direct Deposit Program.
BACKGROUND SCREENING REQUIREMENT: It is the policy of the Florida
Agency for Persons with Disabilities that applicants for employment
undergo Level 2 employment screening in accordance with the
requirements of Chapter 435, Florida Statutes, as a condition of
employment or being permitted to serve as a volunteer.
No applicant for a designated position will be employed or
permitted to volunteer until the Level 2 screening results are
received, reviewed, and approved by the Agency.
Level 2 background screening shall include, but not be limited to,
fingerprinting for Statewide criminal and juvenile records checks
through the Florida Department of Law Enforcement, and Federal
criminal records checks through the Federal Bureau of
Investigation, and may include local criminal records checks
through local law enforcement agencies. THIS POSITION REQUIRES A
BACKGROUND INVESTIGATION INCLUDING FINGERPRINTING, PURSUANT TO S.

information. *** ***DUTIES: Employees of the Agency for Persons
with Disabilities are required to demonstrate total commitment to
outstanding customer service. This includes, but not limited to,
acting in a responsive, professional, courteous manner with the
employees, customers, and public we serve at all times. The Senior
Attorney in this position is under the direct supervision of the
Deputy General Counsel, in the Office of the General Counsel, and
provides legal representation to the Agency for Persons with
Disabilities (Agency) in Medicaid-related litigation in various
forums before the Office of Appeal Hearings, the Division of
Administrative Hearings, as well as other state or appellate
courts, as required. The Senior Attorney will represent the Agency
in Medicaid Waiver Fair Hearings in person, by video conference,
and audio conference. The Senior Attorney's representation of the
Agency shall be conducted in a manner that is timely,
well-researched, thorough, and diligent, with a high degree of
professionalism, with a minimal amount of supervision and exercise
of sound independent professional judgment. The Senior Attorney
shall perform a variety of complicated legal services. The Senior
Attorney shall analyze legal issues, as well sound legal advice,
and guidance on complex Agency issues. The Senior Attorney shall
timely respond to oral and written requests from Agency personnel,
as directed by the Deputy General Counsel or the General Counsel.
In providing legal advice to the Agency, the Senior Attorney shall
adequately explore the underlying facts, engage in discussions with
appropriate staff, carefully research the law, as applicable, to
furnish proper legal guidance to the Agency. The Senior Attorney
shall conduct legal research, interpret statutes, review
regulations, rules, relevant handbooks, operating procedures, as
necessary, to carry out professional duties and responsibilities in
advising the Agency in legal matters. The Senior Attorney will
provide training to Agency staff as needed on relevant procedures
and hearings. The Senior Attorney is required to manage the
administrative tasks associated with this position such as
scheduling hearings, maintaining calendars, preparing evidence
packages, coordinating witnesses, et cetera. The Senior Attorney is
required to travel, as needed. The Senior Attorney may handle other
cases besides Fair Hearing Cases, as needed. The Senior Attorney is
required to prepare reports, as directed by the Deputy General
Counsel or the General Counsel. The Senior Attorney will be
required to perform other duties, as needed. The State of Florida
