Qualifications:
- Must have a valid driver's license; and
- Must be a member of The Florida Bar in good standing; and
- Must have at -least one year of professional experience in the
practice of law. The Work You Will Do: The Office of the General
Counsel, Executive Office Unit, is seeking a highly motivated
individual who is organized, possesses excellent writing skills,
and has the ability to take initiative and build strong, productive
relationships. This position is located in Tallahassee, Florida.
This is a highly-responsible position in the Office of the General
Counsel that will work under the direction of the Chief Appellate
Attorney for the Office of General Counsel. This position will
assist the Division in rule making under Ch. 120, F.S. and Ch. 1-1,
F.A.C. Duties and Responsibilities:
- Must have complete knowledge/understanding of rulemaking
process in Ch. 120, F.S. and Ch. 1-1, F.A.C.;
- Managing rulemaking for the Department, non-board professions &
Child/Farm Labor;
- Drafting and publish Departmental rulemaking language,
paperwork, and notices;
- Serving as primary liaison to Joint Administrative Procedures
Committee (notifying JAPC of rulemaking, responding to JAPC
comments, etc.);
- Serving as primary liaison to Office of Fiscal Accountability &
Regulatory Reform (notifying OFARR of rulemaking, responding to
requests or comments from OFARR);
- Corresponding with public regarding Department's
rulemaking;
- Filing proposed rules for adoption with the Florida Department
of State;
- Overseeing the Department's Annual Regulatory Plan;
- Corresponding with the Office of the Attorney General regarding
rulemaking and the Annual Regulatory Plan;
- Overseeing the Department's Annual Rule Review;
- Assisting Divisions by providing legal services by reviewing
rulemaking language;
- Assisting and training rule coordinators;
- Ensuring non-attorney rule coordinators understand the
requirements of Ch. 120, F.S. and Ch. 1-1, F.A.C.;
- Ensuring agency staff are made aware of new requirements
regarding the rulemaking process;
- Maintaining and updating Rulemaking guides and templates;
- Legal counsel to non-board professions;
- Drafting Declaratory Statements for Department and non-board
professions;
- Communicating with public regarding declaratory
statements;
- Drafting Final Orders for non-board professions when
necessary;
- Performing analysis for legislative proposals and bills
monitored by the Department; suggests changes to language when
necessary; -
- Advising on the laws surrounding emergency rulemaking;
- Defending Departmental rule challenges at the Division of
Administrative Hearings; and
- Generally providing rulemaking legal advice to the Department's
